Elton’s son, Anson, aged 21, was studying at The Happy University. It was a
contractual requirement that students in residence at the university could not
consume any alcoholic drink. Anson therefore quitted drinking. Elton was worried
that Anson would start drinking again under examination pressure and peer
influence. Therefore, Elton promised to pay Anson HK80,000 if he did not drink at all
until he had completed the course. Elton also promised Anson to buy him a car if he
passed his final examination.
Elton runs a business in property management and asked Anson to prepare a tender
document for business development. Elton was satisfied with Anson’s performance,
and he would give him another HK10,000 for all his hard work.
Anson passed his final examination and has not started drinking again.
Elton has not either made the promised payments, or bought the car. He seeks your
advice as to whether he is legally obliged to do so.
